Terms of Service and Acceptable Use Policy

Your continued use of our services indicates acceptance of these terms, conditions and policies.

CRAIG BASS/BLUEHOST TERMS OF SERVICE

Craig Bass, independent web designer and hosting provider, resells the hosting services of Bluehost.com and is legally bound to, and has adopted, the Policies thereof.   As a customer/client of Craig Bass, independent web designer and hosting provider, You are likewise legally bound to these Policies. If you disagree with any of these Policies, you must cancel your account with Craig Bass, independent web designer and hosting provider.

1. These are the terms You agree to when ordering services from or continuing as a customer/client of Craig Bass, independent web designer and hosting provider. The Agreement incorporates the following documents by reference: the plan Description that describes the services You are buying and related fees; these Terms of service (TOS); the Craig Bass, independent web designer and hosting provider TOS (printed following the Bluehost TOS below), and the Privacy Policy. When we use the term "Agreement" or "Agreements" we are referring collectively to all of them.

2. It is understood that the BLUEHOST.COM Terms of Service are specifically those of BLUEHOST.COM, and that all clients/customers of Craig Bass Web Design and Hosting are legally bound to these terms.  The BLUEHOST.COM TOS is accessible by clicking on this link: BLUEHOST.COM TERMS OF SERVICE

3. It is further understood that Craig Bass, independent web designer and hosting provider, other than being a reseller of their hosting services, is NOT otherwise affiliated with Bluehost, and any billing, guarantee/warranty, or refund information shown in their terms at the above link may not accurately reflect the billing, guarantee/warranty or refund information applied to Craig Bass, independent web designer and host’s hosting clients.  As web hosting clients of Craig Bass, independent web designer and hosting provider, you must contact Craig Bass, NOT Bluehost, for any issues.  Bluehost will not directly provide technical support or service to clients of their resellers, including Craig Bass, independent web designer and hosting provider.

The Following Section Comprises Craig Bass, independent Web designer's specific client Terms regarding Website Design and Hosting services and fees and is to supercede similar or conflicting content in Bluehost's Terms of Service above.

Hosting Fees:

Hosting fees are charged in advance, and may be paid for monthly, quarterly, semi-annually or annually.

Web Site Update and Maintenance Fees:

Requested site updates are billed at our standard hourly rate, with a one-half-hour minimum.  All requested site updates will be invoiced daily as performed. Monthly statements will be generated on or about the 15th of each month.  If you would like to establish a monthly maintenance agreement by retainer, please contact us.

Billing Cycle and Late Payments

The Billing Cycle begins on the fifteenth day of the month following the day services are initially ordered, and runs from the 15th of a month to the 14th of the following month.

All payment must be made in US dollars. Payment for services may be made by Money Order, business or personal checks. You may also pay your bill by credit card using PayPal by clicking here or on the "Make a Payment" button on the home page of this website. While this is technically a PayPal donation function, its use herein is as a means of allowing you to specify the amount of payments and make said payments.

If payment on any statement is not received on or before the 5th day of the month following the statement date, a five dollar ($5.00) late payment fee will be added and no further updates will be performed until your account is paid in full. This late fee will accrue each month that your account is in arrears.  Note that we do not differentiate between hosting and other services in past due accounts; any payment received will be applied first to the past due amount and then to the current charges, regardless of whether you specify your payment to be “for hosting only” or similar.

If an invoice for any services associated with an account with Craig Bass is not paid within thirty (30) days after the date of the invoice, a past due notice along with a "Notice of Impending Suspension" may be mailed out.

If no payment has been received within sixty (60) days following date of invoice, the account will be suspended and all access to your files and site will be shut off. This means that your website will not be visible on the Internet, nor will you be able to access your website via FTP.  To have your account unsuspended due to a non-payment, a twenty five dollar ($25.00) service charge will apply in addition to the amount past due.

We must assume that if an account has been allowed to become over ninety (90) days late, it is the customer's intent to discontinue utilizing our services and terminate the account. Accounts that remain unpaid for ninety (90) days following date of invoice are subject to removal from the server. To have your site reloaded onto the server after being removed for nonpayment, a non refundable one hundred fifty US dollar ($150.00) reactivation fee must be received in addition to the full amount previously due.

If your non-payment results in termination, your data will be deleted and no longer retrievable. You hereby acknowledge that this is Craig Bass's policy when it comes to data retention, and waive all rights in and to your data in these situations.

In the event that a client has been allowed to accumulate a debt beyond the due date of a payment and the client then makes a partial payment on any outstanding amount, such payment will be offset against the largest and/or oldest amount outstanding.

Uncollected past due accounts are subject to submission to a third-party collection agency. Client shall be liable for all fees associated with such collection actions. Accounts which have been placed with collections will be subject to the late payment fee as described above.  While Craig Bass, in dependant web designer does not report accounts to credit agencies, accounts submitted to a collection agency may have a detrimental effect on client's credit rating.

In the case of a disputed charge on an invoice, Client shall pay the undisputed amount and provide a letter of dispute describing why they feel the total amount billed is in error. We will investigate and may amend the disputed invoice if such action appears to be warranted.

Craig Bass is not liable for any loss of profits, projected profits, or the loss of any other monetary or non-monetary benefits resulting from the use or termination of an account.

There is a twenty-five US dollar ($25) service charge for returned checks or credit card charge backs.

It is not our desire to put any of our clients out of business. If you are experiencing an unusual hardship and are finding it difficult to pay your amount due in full, please call for arrangements to avoid suspension/removal of your account. However, no leniency that we may show in terms of any of the above at any time, will in any way and under any circumstances constitute a waiver of any of our rights to enforce any and all of our terms and conditions at any time in the future.

Domain Name services

If You use our Domain Name services to register, renew or transfer a domain name, you agree Craig Bass's sole responsibility is to submit the request to Enom (the "Registrar"). Craig Bass is not responsible for any errors, omissions or failures of the Registrar. You are solely responsible for the costs of the Domain Name services. All Domain Name services must be paid in full before we will submit the request to the Registrar and all Domain Name services sales are final and exempt from the Money Back Guarantee. Your use of domain name services is subject to the applicable legal terms of the Registrar posted on their website. You are responsible for managing your domain(s), closing any account with any prior reseller of or registrar for the requested domain name, and you are responsible for responding to any inquiries sent to you by the Registrar.

Please note that domain name registration made through Craig Bass will NOT necessarily automatically renew at the end of each registration period. If we have registered your domain name, or transferred your domain name to our registrar, we will attempt to notify you by E-mail at least thirty (30) days prior to the end of your registration period that your domain name is due to expire.  Nevertheless, it is Your responsibility to know when your domain name is due to expire, and Craig Bass is not responsible for domain name registrations which have been allowed to lapse.

To check on the expiration date of your domain name, visit enom.com, betterwhois.com or who.is and input your domain name. While there, please review the contact information listed for your domain name. If it is incorrect, please notify us or whoever registered your domain name.

Please be aware that if your domain name expires, all email, website, or other services that were associated with it will be affected. Additionally, if your domain is not renewed prior to the expiration date, it will go into a “Redemption Period” during which the registrar may charge up to two hundred fifty dollars ($250.00) to reactivate the domain. We have no control over this fee. After being in the Redemption Period, which lasts from 60 to 90 days, un-renewed domain names are returned to the open market and are subject to registration by other parties.

If you have registered your Domain Name through any registrar independent of Craig Bass, it is not our responsibility to notify you of pending expiration dates.  This is because unless you have named us as billing contact on that account, we will receive no notification that the domain is pending expiration. 

Keeping track of Your domain's expiration date is wholly Your responsibility and Craig Bass will not be held liable for any downtime and/or resulting loss of income resulting from the expiration of Your domain name.

Reservation of Rights
Craig Bass Web Hosting reserves the right at all times to require changes, disable as necessary any website, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency, without notice if necessary. We also reserve the right to prohibit activities that damage Craig Bass Web Hosting's commercial reputation and goodwill. Any material that, in our judgment, is obscene or threatening or otherwise violates our agreements is prohibited. Craig Bass, independent Web designer and hosting provider will be the sole arbiters as to what constitutes a violation of this Policy.
